Rider Partner Terms & Conditions
Effective date: July 2026
By agreeing to these Terms, the Rider confirms that he/she has read, understood, and voluntarily agreed to these Rider Partner Terms and Conditions.
1. Rider Accreditation & Eligibility
1.1 Rider accreditation is subject to final approval by Pasugo and does not guarantee a minimum number of orders, trips, or earnings.
1.2 The Rider represents that he/she is of legal age, possesses the physical and mental capacity to operate a commercial delivery vehicle, and holds all required legal documentation.
1.3 The Rider is solely responsible for procuring and maintaining the tools of his/her trade, including but not limited to:
- A working, compatible mobile smartphone;
- A stable, active internet or mobile data connection;
- The lawful ownership, use, or lease of a roadworthy delivery vehicle;
- Fuel, routine maintenance, and all other operational costs necessary for completing deliveries.
1.4 The Rider shall maintain valid driver's licenses, vehicle registrations (OR/CR), barangay clearances, and other documents reasonably required by Pasugo during onboarding or periodic re-verification.
1.5 Unless otherwise approved under a separate Pasugo scheduling or incentive program, the Rider retains absolute freedom to choose when to go online, when to log off, and whether to accept or decline any delivery opportunities.
2. Independent Contractor Relationship
2.1 The Rider is engaged strictly as an independent contractor partner and not as an employee, regular worker, agent, or servant of Pasugo.
2.2 Nothing in these Terms creates an employer-employee relationship, fixed salary arrangement, partnership, agency, or joint venture. The Rider explicitly waives any claims to regular employment status.
2.3 Pasugo does not guarantee, provide, or absorb liability for:
- Fixed working hours or shifts;
- Minimum or guaranteed daily, weekly, or monthly earnings;
- Employee benefits (including 13th-month pay, holiday pay, or service incentive leaves);
- Overtime pay or night shift differentials;
- Continuous, uninterrupted delivery assignments.
2.4 The Rider remains exclusively responsible for his/her own taxes, local business permits, health and accident insurance, and statutory government contributions (such as SSS, PhilHealth, and Pag-IBIG), unless otherwise provided in writing by Pasugo.
2.5 The Rider shall not represent himself/herself as an employee, officer, or manager of Pasugo, and may identify only as an accredited Pasugo Rider Partner.
3. Delivery and Service Rules
3.1 The Rider shall strictly follow the operational delivery procedures, safety protocols, and application processes implemented by Pasugo, including real-time pickup confirmation, status updates, electronic proof of delivery, and completion procedures.
3.2 The Rider shall:
- Complete only legitimate, system-assigned orders;
- Deliver orders directly to the correct customer at the designated drop-off point;
- Handle food, beverages, and sensitive items carefully, hygienically, and respectfully;
- Refrain from opening, tampering with, or altering sealed merchant packages.
3.3 The Rider shall communicate courteously and professionally with customers, merchants, and Pasugo support personnel, and shall promptly report delivery delays, accidents, or operational concerns.
3.4 The Rider shall not falsely, maliciously, or prematurely mark orders as delivered, canceled, failed, or picked up when such events did not actually occur.
3.5 To facilitate immediate post-delivery support, the in-app chat function between the Rider Partner and the Customer shall remain active for twelve (12) minutes following the system-marked completion of the delivery. The Rider Partner is expected to communicate professionally if contacted by the Customer within this window.
4. Delivery Coverage and Distance Limitations
4.1 The Rider acknowledges that Pasugo operates exclusively within designated service areas or such other zones as may later be determined by Pasugo.
4.2 The Rider may only accept and complete delivery requests within the approved service areas identified within the Pasugo application.
4.3 During the initial pilot phase, the designated service areas include the following barangays:
- Basalem
- Bliss
- Del Monte
- Labrador
- Maganay
- Manlin
- Poblacion
4.4 Deliveries shall generally be limited to a maximum service radius of five (5) kilometers from the merchant location, unless otherwise dynamically approved or adjusted by the Pasugo platform.
4.5 Pasugo reserves the absolute right to add, remove, expand, reduce, or modify service areas and delivery distance limitations at any time based on operational needs, rider density, weather, safety, market demand, or other business factors.
4.6 Orders originating from or directing to areas outside the designated service areas or beyond the permitted distance may be declined, restricted, canceled, or made subject to additional dynamic surcharges as determined by Pasugo.
5. Payments, Cash-on-Delivery (COD), and Canceled Orders
5.1 For approved COD orders with a total purchase amount of Five Hundred Pesos (₱500.00) and below, the Rider shall advance the payment to the merchant upon pickup and subsequently collect the corresponding order amount and delivery fee from the customer upon successful delivery.
5.2 For orders with a total purchase amount exceeding Five Hundred Pesos (₱500.00), the customer shall pay the merchant through GCash or another platform-approved digital payment method before the order is processed, cleared, or released to the Rider for delivery.
5.3 If a Rider Partner advances payment for a legitimate COD order under Section 5.1 and the customer unjustifiably refuses delivery, fails to appear, or cancels mid-transit through no fault of the Rider Partner, Pasugo shall reimburse the advanced amount provided that:
- The Rider Partner submits proper proof of the attempted delivery via the Application (including waiting at the drop-off location for a minimum of 20 minutes, submitting photos of the location, and attempting to contact the customer via call or in-app messaging);
- The Rider Partner immediately reports the failed delivery to Pasugo Support and follows all instructions regarding handling, return, or disposal of the canceled Goods;
- Upon successful verification that the cancellation was not due to the Rider Partner's fault, Pasugo credits the reimbursed amount to the Rider Partner's designated wallet or account within 1 to 3 Business Days;
- Pasugo reserves the absolute right to deny reimbursement if it detects fraudulent activity, collusion, or failure to follow the prescribed verification protocols.
5.4 Pasugo reserves the right to modify, overhaul, or implement different payment systems, digital wallets, or collection processes for operational, security, or fraud-prevention purposes.
5.5 The Rider shall keep only the authorized delivery fee and approved bonuses or reimbursements. All merchant payments and customer collections must be remitted through the platform's standard settlement process.
5.6 Pasugo may implement automated monitoring systems, verification measures, and platform controls for safety, fraud prevention, quality assurance, and operational purposes, including reviewing rider performance based on reliability indicators like completion rates and customer complaints. Performance metrics are used solely for platform access prioritization and incentives and do not constitute employment supervision.
6. Account Security, Intellectual Property, and Privacy
6.1 The Rider shall not share, sell, rent, or transfer his/her platform account to any third party and is solely liable for all activities occurring under their account.
6.2 The Rider shall not use fake identities, submit falsified documents, manipulate GPS location ("spoofing"), alter delivery records, or engage in any fraudulent activity intended to game the platform's incentive structures.
6.3 The Rider shall promptly update Pasugo regarding any changes in contact details, license validity, vehicle ownership, or other required records within twenty-four (24) hours of such change.
6.4 Data Privacy Compliance (RA 10173): Pasugo collects, stores, and processes the Rider's personal data, real-time location, and operational metrics in strict compliance with the Philippine Data Privacy Act of 2012. The Rider consents to this data collection for platform operations, verification, fraud prevention, safety, and dispute resolution.
6.5 The Rider shall treat all customer and merchant information as strictly confidential and shall use it only for the specific delivery assigned and for addressing immediate post-delivery concerns within the authorized twelve (12) minute in-app chat window. After the expiration of this window, the Rider is strictly prohibited from contacting the Customer. Any unauthorized personal contact or harassment outside this window shall result in immediate permanent account deactivation and potential legal action.
6.6 All intellectual property rights over the Pasugo application, trademarks, logos, and system designs belong exclusively to Pasugo. The Rider shall not copy, decompile, or reverse-engineer the application.
7. Indemnification and Limitation of Liability
7.1 The Rider agrees to indemnify, defend, and hold harmless Pasugo, its parents, affiliates, directors, officers, and employees from any and all claims, losses, civil liabilities, criminal charges, traffic fines, damages, bodily injuries, or deaths arising out of the Rider's negligence, willful misconduct, traffic violations, or operational performance of delivery services.
7.2 Pasugo operates strictly as an intermediary technology platform and shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits or personal property damage, suffered by the Rider while online or performing deliveries.
8. Suspension, Deactivation, and Grievance
8.1 Pasugo may temporarily suspend, restrict, or permanently deactivate a Rider's account for operational, safety, fraud, or policy-related violations.
8.2 Valid grounds for account action include, but are not limited to:
- Repeated, unexplained service failures or high cancellation rates;
- Proven fraudulent conduct, collusion, or financial manipulation;
- Abusive language, harassment, or unsafe behavior toward customers or merchants;
- Operating a delivery vehicle under the influence of illegal substances or alcohol;
- Expiration of valid driver's licenses or mandatory permits;
- Violations of cash-handling or COD remittance limits;
- Serious, verified safety or behavior complaints.
8.3 Certain critical violations (such as assault, theft, or explicit fraud) shall result in immediate, permanent deactivation without prior warnings.
8.4 In the event of a suspension or deactivation, the Rider shall have access to an online grievance review mechanism to appeal the decision and present evidence, subject to final review by Pasugo management.
9. Governing Law and Dispute Resolution
9.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
9.2 Before filing any formal legal action, the Rider and Pasugo agree to undergo a mandatory thirty (30) day informal mediation period to resolve any contractual or monetary disputes.
9.3 If mediation fails, any legal action shall be filed exclusively in the proper courts of Zamboanga Sibugay, to the exclusion of all other venues and jurisdictions.
10. Amendments & Severability
10.1 Pasugo reserves the right to update, modify, or amend these Terms at any time. Continued use of the platform and logging online after such updates constitutes explicit, legally binding acceptance of the revised Terms.
10.2 If any provision is declared invalid, illegal, or unenforceable by a competent court or regulatory body, the remaining provisions shall remain in full force and effect.
11. Final Acceptance
By agreeing, the Rider explicitly confirms that he/she has read, fully understood, and voluntarily consented to all provisions of these Terms and Conditions; agrees to strictly comply with all platform rules and standard operating procedures; and fully acknowledges and accepts the independent contractor nature of this arrangement with Pasugo.
